1. Acceptance of Terms
Welcome to CalcuMentor! These Terms of Service ("Terms") govern your access to and use of CalcuMentor's mobile application, website, and related services (collectively, the "Service"). By using CalcuMentor, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.
For users under 13: Parents or guardians must create and manage the account on behalf of the child in compliance with COPPA (Children's Online Privacy Protection Act).
3. Account Registration
To access certain features, you must create an account using Google Sign-In or Apple Sign-In. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
You may not share your account, create multiple accounts, or transfer your account to another person without our permission.
4. Subscription and Access
4.1 Pricing
The Math Pass is a monthly subscription (currently $14.99 USD per month, or equivalent in your local currency). Prices may change in the future; we will notify you of any material changes before they take effect.
4.2 Payment Processing
Payments are processed either through Apple In‑App Purchases on iOS or through Stripe on the web. For Apple purchases, you agree to Apple's terms and manage your subscription in your Apple ID settings. For web purchases, you agree to Stripe's Terms of Service and authorize us to charge your payment method on a recurring basis. Web checkout currently supports Google Sign‑In.
4.3 Access
Your subscription grants access to eligible math courses while your subscription is active. Access is tied to your account and is non-transferable. Purchases made on the web sync to your CalcuMentor account and appear in the app.
4.4 Cancellation
You can cancel at any time. Your access will continue until the end of your current billing period unless otherwise stated.
4.5 Promo Codes
Promo codes may be offered for free or discounted access. Codes are subject to expiration, usage limits, and may be revoked for abuse.
5. Refund Policy
We want you to be satisfied with CalcuMentor. If you're not happy with your subscription:
- iOS Purchases: Subscriptions purchased through the iOS app are managed by Apple. Refunds for iOS purchases must be requested directly from Apple at reportaproblem.apple.com. CalcuMentor has no ability to issue refunds for Apple in-app purchases.
- After 7 days: Refunds are at our discretion and will be evaluated case-by-case
Promo code redemptions and class enrollments granted by teachers are not eligible for refunds.
6. User Conduct
You agree to use CalcuMentor responsibly and ethically. You may NOT:
- Share answers or solutions with other users (academic integrity violation)
- Use automated tools, bots, or scripts to interact with the Service
- Attempt to reverse-engineer, decompile, or hack the Service
- Share your account credentials or purchase access for others
- Upload malicious code, viruses, or harmful content
- Abuse, harass, or threaten other users or staff
- Violate any applicable laws or regulations
- Use the Service for any commercial purpose without permission
Violation of these rules may result in account suspension or termination without refund.
7. Teacher and Class Features
Teachers can create classes and invite students via enrollment codes. By joining a class:
- You grant your teacher access to view your progress, attempts, and analytics
- Your teacher can assign problems and track your completion
- You understand that your work is visible to your teacher for educational purposes
Teachers agree to use student data only for educational purposes and to comply with applicable privacy laws (FERPA, COPPA, GDPR).
8. Intellectual Property
8.1 Our Content
All content on CalcuMentor, including course materials, problems, AI-generated feedback, software, and design, is owned by CalcuMentor or licensed to us. You may not copy, distribute, modify, or create derivative works without our written permission.
8.2 Third-Party Content
Some course content is provided by third-party licensors. We provide attribution and license details where applicable.
8.3 Your Content
You retain ownership of your handwritten work and solutions. By using the Service, you grant us a non-exclusive, worldwide license to:
- Process your work through AI models (OpenAI, MathPix) for tutoring purposes
- Store and display your work within your account and to your teachers
- Use anonymized, aggregated data to improve our Service
We will never publish or share your individual work publicly without your explicit consent.
9. AI-Generated Content
CalcuMentor uses AI models (GPT-4, MathPix) to provide tutoring and evaluate your work. You understand that:
- AI responses may occasionally contain errors or inaccuracies
- AI feedback is educational guidance, not a substitute for human teachers
- We strive for accuracy but cannot guarantee 100% correctness
- Final academic decisions (grades, assessments) should involve human review
10. Disclaimers
CalcuMentor is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee that:
- The Service will be uninterrupted, error-free, or secure
- Results or outcomes will meet your expectations
- Defects will be corrected immediately
- Content is accurate, complete, or up-to-date
Your use of CalcuMentor is at your own risk. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, CalcuMentor and its officers, directors, employees, and agents shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or errors
- Third-party conduct or content
Our total liability for any claim arising from your use of CalcuMentor shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless CalcuMentor from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or share
13. Account Termination
13.1 By You
You may delete your account at any time by contacting support@calcumentor.com. Deletion is permanent and cannot be undone. Refunds are subject to our refund policy (Section 5).
13.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or our policies
- Engage in fraudulent or illegal activity
- Abuse the Service or other users
- Remain inactive for an extended period (we'll notify you first)
Termination does not entitle you to a refund unless required by law.
14. Third-Party Services
CalcuMentor integrates with third-party services (Firebase, RevenueCat, OpenAI, MathPix, Sentry). Your use of these services is subject to their own terms and policies:
We are not responsible for third-party services or any issues arising from their use.
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute, please contact us at support@calcumentor.com first. We'll work with you in good faith to resolve the issue.
15.2 Binding Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration (except for small claims court). You waive your right to a jury trial or class action lawsuit.
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is final and binding.
15.3 Exceptions
Either party may seek injunctive relief in court for intellectual property violations or urgent matters requiring immediate action.
16. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in California.
If you're located outside the U.S., you also agree to comply with your local laws regarding online conduct and acceptable content.
17. Changes to Terms
We may update these Terms from time to time. We'll notify you of material changes by:
- Posting the updated Terms on this page with a new "Last updated" date
- Sending an email to your registered address (for significant changes)
- Displaying an in-app notification upon your next login
Your continued use of CalcuMentor after changes take effect constitutes acceptance of the new Terms. If you don't agree, stop using the Service and contact us to delete your account.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CalcuMentor regarding your use of the Service. They supersede any prior agreements or understandings.
